Purchaser, by placing an order, makes an offer to purchase pursuant to these terms and conditions, which offer, if accepted by Unique Design, is accepted within Namibia, and purchaser consents to the jurisdiction of the courts of Windhoek for the limited purpose of dispute arising between the parties resulting from this transaction and agrees that the laws of Namibia shall apply.
By opening or using a product purchased from Unique Design, the purchaser agrees to be bound by the term and conditions of sale as set forth below. If you do not agree to the terms and conditions of sale, please ship the product back to Unique Design unopened within 10 days of receipt for a full refund (less shipping and handling charges). Administration costs might apply if Goods are later than stated above.
Unique Design makes no warranty, either expressed or implied, of merchantability or fitness for any particular purpose, and none shall be implied by law.
Final determination of suitability of any item sold for the use contemplated by purchaser is the sole responsibility of the purchaser, and Seller shall have no responsibility in connection with such determination. It is the responsibility of the purchaser to ensure the size of the bedroom, living room, office allow furniture fitting.
Unique Design will not be responsible for any consequential or incidental damages resulting from the sale, non-delivery, use or improper function of any equipment purchased from us. The responsibility, if any is imposed, of Unique Design in regard to any item purchased shall be limited to the monetary value of the merchandise purchased.
Unique Design is intended to be a guide only. Some item illustrations are for display purposes only, may not be exact, and are not necessarily included in the purchase price. Unique Design is not responsible for typographical or pictorial errors, and specifications may change without notice.
All items offered for sale are subject to availability. Many items on our Web site or catalog site come from Europe or China and are in most cases uniquely made for Unique Design. Should it apply to your order that the item cannot be produced as intended, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. For most items different colors can be chosen, in case different colors than the standard color combination is chosen the customer is aware the the delivery can take 12-16 weeks. This can also apply the our standard items when they run out of stock. Every customer has the right to ask for the delivery time frame independent if the order is already placed or not.
All prices shown on our website are for furniture in our Windhoek location, price for Ondangwa differs from prices on our website, delivery from our showroom to your location is not included on our web prices. We make every effort to provide you with an error-free Web site. However, in the event there is a misprint, we reserve the right to correct copy or pricing to reflect the actual current status.
Order confirmation given to you through Unique Design does not guarantee our acceptance of your order, nor does it constitute confirmation of an offer to sell. Unique Design reserves the right to decline and cancel an order, or supply less than quantity ordered at any time. However we do our outmost possible to fulfill your order to your satisfaction.
In case you purchase on account. The item remains the ownership of Lifestyle Unique Design CC until the full agreed amount has been paid. In case 3 installments are not paid Lifestyle Unique Design CC has the possibility to repossess the purchased items and payments done by the customer remain with Lifestyle Unique Design CC.
At times, we may experience a shortage of certain items. At these times, we reserve the right to have longer delivery times. We will notify you if a situation like this occurs.
Late payments: Should you fail to make payment and fall in arrear, 17% interest will be charged monthly on the outstanding amounts up to 11 months. From 12 months, 20% interest per annum will be charged. A monthly Late Payment Fees and Administration costs of N$ 500.00 will be charged.
Failure to make payment to the service/credit provider within the agreed period from date of purchase may result in legal action commenced against you without further notice and will result in us listing your default on the TRANSUNION NATIONAL CREDIT DATABASE, which could negatively affect your ability to obtain credit and adversely affect any credit facilities you currently enjoy.
